These Terms of Service and Conditions (“Terms”) govern the use of the No Gamer Left Behind Foundation (“NGLB”, “we”, “our”, or “us”) website, programs, services, and events. By accessing our website, booking a service, or participating in any NGLB event, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not use our website or services.

1. ABOUT NGLB

The No Gamer Left Behind Foundation is a not-for-profit organization providing gaming events, group programs, therapeutic play facilitation, educational workshops, and community engagement services. Our programs are delivered on-site at client locations, community spaces, partner venues, and public or private event spaces.

2. USE OF THE WEBSITE

By using our website, you agree that:

  • You will provide accurate and complete information
    • You will not use the website for unlawful or harmful purposes
    • You will not attempt to disrupt or disable website functionality
    • You are responsible for maintaining the confidentiality of any information submitted

NGLB may update, suspend, or change website features at any time without notice.

3. EVENT BOOKINGS AND SERVICE AGREEMENTS

Event bookings are subject to availability and are not considered confirmed until:

  • A written proposal has been approved
    • A service agreement has been accepted
    • A non-refundable 35% deposit has been received

Final payment is due according to the schedule outlined in the specific service agreement.

NGLB may decline or cancel bookings that conflict with organisational policies, safety standards, or community guidelines.

4. FEES, PAYMENT, AND REFUNDS

  • A 35% non-refundable deposit is required to secure any event date
    • Remaining balances must be paid according to the agreed terms
    • Additional fees may apply for specialised programming, travel, staffing, or equipment
    • A security deposit may be required for high-value gaming assets
    • Refunds are provided only in accordance with the written service agreement

If NGLB must cancel an event due to unforeseen circumstances, clients may receive a refund or the option to reschedule.

5. CLIENT RESPONSIBILITIES

Clients agree to:

  • Provide a safe, accessible venue suitable for participants and staff
    • Ensure adequate space, tables, seating, and lighting
    • Communicate all accessibility needs or accommodations prior to the event
    • Inform NGLB of group risks, behavioural concerns, or special requirements
    • Supervise minors when required by law or organisational policy

NGLB may refuse to run an event if conditions are unsafe or inconsistent with our values.

6. PARTICIPANT CONDUCT

All participants must follow NGLB’s All-Inclusive Gaming Policy, including:

  • Respectful behaviour toward staff, volunteers, and participants
    • Zero tolerance for harassment, discrimination, or disruptive conduct
    • Compliance with facilitator instructions and safety guidelines
    • Respect for games, equipment, and venue property

NGLB may remove individuals or end events early if conduct policies are violated.

7. YOUTH, SENIOR, AND VULNERABLE PARTICIPANT PROGRAMS

Programs involving minors, seniors, or vulnerable individuals may require:

  • Parent or guardian consent
    • On-site supervision from responsible adults
    • Emergency contact information
    • Advance communication of medical, accessibility, or behavioural considerations

NGLB follows community program standards to protect participant safety and well-being.

8. RISK ACKNOWLEDGEMENT

Participation involves minimal physical risk but may require cognitive or emotional engagement. By participating, you acknowledge that:

  • You assume all typical risks associated with recreational gaming
    • You accept responsibility for your actions during the event
    • You will disclose relevant concerns or limitations prior to participation

NGLB is not responsible for injuries or incidents arising from unsafe behaviour, undisclosed conditions, or venue hazards.

9. EQUIPMENT USE AND DAMAGE

Clients and participants agree to:

  • Use games and materials as intended
    • Report any damage immediately
    • Acknowledge that misuse resulting in damage may incur repair or replacement charges

Security deposits may be applied or withheld according to the service agreement.

10. INTELLECTUAL PROPERTY

All original NGLB materials, including therapeutic curricula, wargaming scenarios, teaching aids, and written content, are protected by copyright.

Clients agree not to:

  • Copy, record, or reproduce these materials
    • Modify or distribute materials without written permission
    • Claim ownership of NGLB-created content

11. PRIVACY AND DATA USE

NGLB collects, stores, and uses personal information in accordance with our posted Privacy Policy. By using our website or submitting information, you consent to those practices.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, NGLB is not liable for:

  • Indirect, incidental, or consequential damages
    • Losses caused by venue-related issues, weather, or third-party service failures
    • Injuries arising from participant behaviour or conditions outside our control

NGLB’s maximum liability is limited to the amount paid for the associated service.

13. INDEMNITY

Clients agree to indemnify and hold harmless the No Gamer Left Behind Foundation, its staff, volunteers, and facilitators from claims or damages arising from:

  • Participant behaviour
    • Venue hazards not controlled by NGLB
    • Misuse of equipment
    • Failure to follow instructions or policies

14. TERMINATION AND REFUSAL OF SERVICE

NGLB reserves the right to:

  • Decline service
    • Modify event plans
    • Remove individuals
    • End events early
    • Cancel future services

This may occur if safety, legal compliance, or organisational values are compromised.

15. GOVERNING LAW

These Terms are governed by the laws of:

  • The Province of Alberta, Canada, for Canadian services and bookings
    • Applicable U.S. laws for U.S.-based individuals accessing the site

Any disputes will be resolved in the jurisdiction where the service originated.

16. CHANGES TO THESE TERMS

NGLB may update these Terms at any time. The revised version will be posted with a new “Last Updated” date. Continued use of the website or participation in services constitutes acceptance of the updated Terms.

Vendor & Sponsor Commitment Form

Please complete the following form if you are ready to commit to becoming a vendor and or a sponsor for an event, project, or organization support.

(Please attach an invoice or appraisal if FMV exceeds $500 for internal accounting purposes.)

4. Sponsor Benefits & Recognition

In exchange for your in-kind contribution, No Gamer Left Behind Foundation agrees to:
1. Include the company logo on event signage and digital platforms.
2. Provide a dedicated booth space (if requested).
3. Mention in social media shout-outs and event program.
4. Acknowledge contributions on gaming tables, as appropriate.

5. Agreement & Signature

By signing below, the Vendor/Sponsor commits to providing the described goods/services to No Gamer Left Behind by the agreed-upon deadline of April 1, 2026.

Exclusivity: No Gamer Left Behind agrees not to offer any other vendors a booth/table at the event that directly competes with the business activities of the vendor/sponsor. Where services/products have potential for overlap, No Gamer Left Behind will specify which vendor/sponsor has the right to sell specific goods/services in their respective agreements. No Gamer Left Behind reserves the right to amend any such vendor/sponsor agreements to ensure consistency with these terms as vendors/sponsors are added.

Liability: The Vendor/Sponsor agrees to indemnify and hold harmless No Gamer Left Behind from any claims arising from the provided goods or services, and that they have adequate insurance to attend the event on behalf of their company.

Representation: The Vendor/Sponsor agrees to conduct criminal record and vulnerable sector checks on their representatives and share these details with No Gamer Left Behind. They further agree to behave in a manner that is respectful and family-friendly. They are required to wear clothing that identifies them as a representative of the vendor/sponsor. No Gamer Left Behind reserves the right to remove any vendor/representative should they breach these terms.

Property: Any equipment provided on a loan basis remains the property of the Vendor/Sponsor unless explicitly stated as a donation. No Gamer Left Behind is not responsible for the loss, theft, and/or damage of any items of the sponsor/vendor.

Contribution/Donation: Should the vendor/sponsor fail to meet its acknowledged contribution/donation, No Gamer Left Behind reserves the right to restrict their access to the event and/or marketing materials.

Public Acknowledgements/Dispute Resolution: No Gamer Left Behind reserves the right to list the vendor/sponsor as a community partner on its website with appropriate branding. The Vendor/Sponsor may also note its partnership/contributions on their website with appropriate branding. Furthermore, it warrants that it will provide appropriate business reviews to vendors/sponsors in accordance with the services/goods they provide for the event. No Gamer Left Behind further agrees not to publicly disparage the vendor/sponsor. As such, No Gamer Left Behind also has the same requirements for its brand and online business reviews. Should an issue arise between both parties, they agree to make best efforts to settle the matter privately between both parties and not publicly disparage each other.

Digital Signature and Acceptance: By entering your full legal name, dating this form, selecting the acknowledgement box, and submitting this online form, you confirm that you are authorized to act on behalf of the Vendor/Sponsor named above. You agree that this electronic submission constitutes your electronic signature under applicable Canadian law, including federal and provincial electronic commerce legislation, and that it is legally binding in the same manner as a handwritten signature. You further confirm that all information provided is accurate and that you agree to the terms set out in this agreement.
